Comrades,
Article 309 & 311 of the Constitution(both) are related to Central Government employees.
GDS Conduct & Engagement Rules, 2011 were not framed under Article 309 of the Constitution of India but under *executive powers (Arbitrary invasion) of Central Government* after approval of the recommendations of the Nataraja Murthy Committee report. Thus these rules are also non statutory in nature.
Why they are not interested to amend or withdraw the executive resolution?
Where Part III of the constitution is to provide protection to the freedoms and rights mentioned therein against arbitrary invasion by the State.
Article 309 of Constitution is controlled by the Doctrine of Pleasure embodied in Article 310. Article 309 make it clear that “Conditions of service whether laid down by the legislature or prescribed by the Rules must conform to the mandatory provisions of the Constitution as laid down in Articles 310,311 and 320 or in Part III of the Constitution.
These Rules should also satisfy such conditions as “EQUAL PAY FOR EQUAL WORK” under Article 39(d).
The power to frame rules under Article 309 includes the power to Amend or Alter the Rules with retrospective effect to the principle, that the benefits acquired the existing rules cannot be taken away by the retrospective effect.(Expressed by Supreme Court in T.K.Kapur v.State of Haryana,1986 Supp.S.C.C. 584)
So in the present scenario the Department of Post can’t take away the provision to the GDSs more fairly should allow the GDSs Civil Servant status with provision of statutory pension to the GDSs joined before 2014 and retiring after serving humbly more than 10 Years, on social security to them.
Otherwise the Fundamental Rights contained in Article 14 ,15,and 16 of the Constitution for the said GDSs in the Country would be forcefully deprived by the welfare State like Great India.
At this juncture, Directorate must convince the Govt.of India consulting the departmental legal wing and do favor to 2,70,000 GDS and their families offering Civil Service Status to the GDSs.

My dear comrades,
The days are passing by, just listening to the odds(vakwas) of the so called recognized leaders .If they would have some thing to do on the issue of GDSs then GDSs would not be victimized so, facing delay of getting their legitimate due of salary and job condition .The innocent GDSs are exploited both by the employer and the false committing Union Leaderships ."Hum chitthi Likha hey bhai" is their crocodile tear to milch the union fund from the concerned innocent GDSs. Shame to them,who are instigating the GDSs to go for strike again and again on the same issue losing their hard earn for their family.What happens this day ask them .Only one option for the GDSs to follow 'intezaar'. As-if the Govt. is going to pass the budget earlier this year probably on November 2017 our patience is to be kept solaced till then .So may I request my Comrades not to be worried till the Session Budget of November when our financial expenditure would be passed in the parliament .Because the seventh Pay Commission ignoring the GDSs has fallen in about 13000 crore deficit to the Department,just ignoring the real earning hands of the Postal Department,i.e.GDSs.
Who would let make out the fact to the Government ,whether the crowned leadership or not ? But they have no time out of attending Divisional /Circle meetings to publish the blog pages with their photos .
Therefore I invite the real thinkers of the GDSs fraternity to swear to avoid the the traditional Recognized GDSs Union to save the career of GDSs .
Because the present scenario is not traditional ,but more inventive or renovating Chitthi likha hey bhai ,is the old tricks to fool the GDSs. Leave this nonsense trick of Union activity to cheat the GDSs.

o The minimum wage has
been increased to Rs. 10000/- per month and maximum pay to Rs. 35480/- per
month.

increase is recommended as 3%.
o A Composite Allowance
comprising of support for hiring accommodation for GDS Post Offices as well as
mandatory residence, office maintenance, mobile and electricity usage charges
etc. has been introduced for the first time.
o Children Education
Allowance @Rs. 6000/- per child per annum has been introduced for GDSs.
o Risk & Hardship
Allowance @Rs. 500/- per month for GDS working in the special areas has also
been introduced.
o A Financial
upgradation has been introduced at 12 years, 24 years and 36 years of services
in form of two advance additional annual increases.
o The Ceiling of
ex-gratia gratuity has been increased from Rs. 60,000 to Rs. 5,00,000
o The GDS Contribution
for Service Discharge Benefit Scheme (SDBS) should be enhanced maximum up to
10% and minimum up to 3% of the basic wage per month, whereas the Department
should contribute a fixed contribution of 3% of the basic wage of the GDSs.
o The coverage of GDS
Group Insurance Scheme has been enhanced from Rs. 50000/- to Rs. 5,00,000/
o The contribution of
Department in Circle Welfare Fund (CWF) has been increased from Rs. 100/ per
annum to Rs. 300/ per annum.
o The scope of CWF is
extended to cover immediate family members such as spouse; daughters, sons and
dependent daughters in law in the scheme.
o The Committee also
recommended 10% hike in the prescribed limits of financial grants and
assistances in the Circle Welfare Funds.
o The Committee has
recommended addition of Rs. 10,000/ for purchase of Tablet / Mobile from the
Circle Welfare in the head “Financial Assistance of Fund by way of loans with
lower rate of interest (5%)”.
o Provision of 26 weeks
of Maternity Leave for women GDS has been recommended.
o The wages for the
entire period of Maternity Leave is recommended to be paid from salary head
from where wages of GDSs are paid.
o The Committee has
also recommended one week of paternity leave.
o Leave accumulation
and encashment facility up to 180 days has been introduced.
o Online system of
engagement has been recommended.
o Alternate livelihood
condition for engagement of GDSs has been relaxed.
o Voluntary Discharge
scheme has been recommended.
o The Discharge age has
been retained at 65 years.
o The Limited Transfer
Facility has been relaxed from 1 time to 3 times for male GDSs. There will be
no restriction on number of chances for transfer of women GDSs. The powers for
transfer has been delegated to the concerned Divisional head.
o The ex-gratia payment
during put off period should be revised to 35% from 25% of the wage and DA
drawn immediately before put off.
o The Committee has
recommended preferring transfer before put off duty.

■DoP is introducing a new system for verification of GDS in which new Declaration form previously numbered will be sent to each employees by the Divisional Head who will fill up,sign it,and drop it in the Divisional office in a separate box.
■understand this is to avoid dual decoration submission.
■DoP is likely to call a meeting with General Secretaries of GDS Unions to discuss the matter.

"We will have post bank footprint in every district by March 2018, and before the end of the calendar year, all 1.55 lakh post offices and every postman and grameen dak sevak, which is another 3 lakh, will be equipped with a device which will provide full range of payment solutions that we will be hosting," India Post Payments Bank (IPPB) Chief Executive Officer A P Singh said at an event organised by United Nations on Financial Inclusion.
In the private space, Airtel Payments Bank, launched in January this year, started operations with a network of 2.5 lakh merchants.

The new model of banking allows mobile firms, supermarket chains and others to cater to banking requirements of individuals and small businesses. It will be set up as a differentiated bank and will confine its activities to acceptance of demand deposits, remittance services, Internet banking and other specified services.

At the event, Telecom Regulatory Authority of India Chairman R S Sharma said transaction cost on digital payment should be very minimal and it should be made affordable.
IPPB, according to Singh, will use Aadhaar as payment address of an individual, indicating that the postal bank may bring the transaction charge close to 1 paisa.
"We will convert it (Aadhaar) into payment address. We will get this activated by offering a host of payment services," Singh said.
"We have taken up the challenge on ourselves as to how we make a R
s.
10 transaction viable. Aadhaar authentication cost less than 1 paisa. There is no reason why a payment transaction should be transacting anything more," Singh said.
At present, private players and even public banks charge transaction fee even on digital payments, depending on the nature of the transaction.

The Union Cabinet on Tuesday approved the release of an additional 1% of dearness allowance (DA) to Central government employees and dearness relief (DR) to pensioners.
This will be applicable retrospectively from July 1, 2017.
“The release of the additional instalment of DA represents an increase of 1% over the existing rate of 4% of the basic pay/pension, to compensate for price rise,” the government said.

My dear Comrades ,
Whereas the mental condition of the GDSs is agonized on today's situation , awaiting for GDSs' pay committee report,the formal old leader is cheerful, due to his achievement to get success in his openion "CHQ received very good news from all Circles regarding membership verification,"is a matter of salt on the wound.
Is the loss of TRCA of the participants in seven days strike period of about Rs.3000/- not agonizing the GDS family members .Whether the pending work of seven days had to clear on joining without remuneration or not? The poor GDSs blindly supporting the leader who does not keep any quality himself to negotiate with the administration by bi-lateral talk and imposes strike and strike on the poor GDSs .As has been seen right from the achievement of agreement for Judiciary committee in 2014.
What yielded for the GDS with the seven days loss of TRCA on last strike?May or may not yield for GDSs,but it yielded much for the Leader, "As per the information, AIGDSU is going to get first position as number one union." the leader says.
It clearly indicates the leader is successful and cheerful to his plan of getting the first position may be on loosing the seven days of TRCA of the common innocent GDSs.
Is this intention of the leader noble or honest ?The leader has always been emphasizing on unity on the great Union of symbol only ,not efficiency .But should not he know that Democracy does not allow single possession or monopoly.Right from 1999 the leader never feels liable to the fate of GDSs rather have been cheerfully enjoying the position as richest General Secretary only due to the non-unitedly innocence of the poor GDSs. Especially the leader has been pet them who can make fool to the others .
The leader never thinks of the constitutional right of the GDSs who have been depriving of the Adjudication on the issue of their legitimate due of service rule and wage structure.The golden fruit of agreement by the Department on 2014 by the sacrifice of about 15 days strike was lost only due to the post strike inefficiency i.e bilateral talk with the Department and the Government by the richest leader ,but now the leader has totally forgotten the issue by his tricky policy of strikes again and again .May I request to think you all to count how many times the leader has been imposing strike since 2014.By this August 2017 whether the leader called the strike in inappropriate issue and engaged the union representatives on collecting forms(for his personal benefit) is a fact or not .I do n't know whether my viewer of this blog would agree with me ,but I find it true .
The leader should know the much number of membership can harvest for him more subscription amount making him rich but not much rich leadership efficiency.As if the leader had no fund to file a suit for the agreement for Judiciary Committee let God give the leader good conscience not to avoid to fight for GDSs with same attitude to use GDSs money for the real cause in future .

Discard the falsity of representatives of GDSs ! Many of the people makes a society with a common cause .But when many of the people follow a evil nature person ,forms a society of wrong .So don't be tempted and misguided by the fact that many people are doing in a society ,because of which I should do .Always a turning point comes carrying a reformation by may be a single person or a few .
As the events of the Nation today followed to a single person dismantling the many politicians is a burning example to prove the fact that many may be wrong and one reformer is enough to bring the truth to light,is followed by others .Democracy does not only mean in-dependence of many,but also dependence of many concentrating at the true leadership .Su( goodness)-Tantra( Rule) not Swa (self)-tantra(rule) .The GDS should realize the same to be concentrated with a goodness leadership ,who actually can bring a reformation of the GDSs society as a whole .The crocodile tear of a leader always brings silent devastation for the GDSs to be offended before other colleagues of the Department.A Leader should be so efficient to settle an issue through his own endeavor instead of making loss to the mass .But the most of the common GDSs are innocent and driven by the wrong local profiting leaderships of the central leader under which the common GDSs are victimized wrongly .
So I request my GDSs fraternity Jago and upheld the condition of the GDSs concentrating with a true leadership of real cause keeping in view the profit of common GDSs not keeping view the profit of a few sub leaders .
